Terms of Service

1. Acceptance of Terms

By engaging with Indalo Africa Financial Solutions (FSP 45841), including through our website at www.indaloafricafs.co.za, you agree to be bound by these Terms of Service and acknowledge that you have read and understood our Key Information Documents and FAIS Disclosures as required by the Financial Advisory and Intermediary Services Act.

2. Regulatory Framework

• We operate under FSP license number 45841
• Governed by the Financial Sector Conduct Authority (FSCA)
• Compliant with the General Code of Conduct for Authorised Financial Services Providers
• Bound by the provisions of the Protection of Personal Information Act (POPIA)

3. Financial Services Provided

As FSP 45841, we provide the following financial services in accordance with our license:

• Financial planning and advisory services
• Short-term insurance products (non-life)
• Risk management solutions
• Estate planning services
• Investment advice (where appropriately licensed)

4. Client Responsibilities

As our client, you agree to:

• Provide complete and accurate information for financial needs analysis
• Disclose all material facts as required by insurance law
• Review all policy documents and product specifications
• Make timely premium payments as agreed
• Notify us immediately of any changes to your circumstances

5. Fees and Charges

Our remuneration structure complies with FAIS requirements:

• Initial consultation fees (where applicable)
• Commission as permitted by the Long-term and Short-term Insurance Acts
• Administration fees for policy maintenance
• All fees will be fully disclosed in your service agreement

6. Cooling-off Period

Where applicable, certain financial products may have a cooling-off period as prescribed by law. Details will be provided in your policy documents.

7. Claims Process

Our claims handling procedures:

• Notification must be made promptly after an incident
• Complete claim forms must be submitted with supporting documentation
• We will facilitate communication with insurers
• Claims are subject to the terms of your policy

8. Limitation of Liability

As permitted by law and our FSP license:

• We act as intermediary, not as insurer
• Policy terms are determined by product providers
• Our liability is limited to gross negligence or willful misconduct
• We maintain professional indemnity insurance as required by FAIS

9. Complaints Procedure

Should you have any concerns:

1. Contact our Compliance Officer at compliance@indaloafricafs.co.za
2. If unresolved within 15 days, you may escalate to the FAIS Ombud
3. Full complaints policy available on request

10. Termination of Services

Either party may terminate the relationship with written notice, subject to:

• Outstanding fees or premiums being settled
• Policy cancellation terms with product providers
• Our regulatory obligation to maintain records for 5 years

11. Governing Law

These terms are governed by South African law, specifically:

• Financial Advisory and Intermediary Services Act (FAIS)
• Short-term Insurance Act (where applicable)
• Protection of Personal Information Act (POPIA)
• Financial Sector Regulation Act

12. Changes to Terms

We may amend these terms to comply with regulatory changes. Material changes will be communicated via:

• Email notification to existing clients
• Notice on our website
• Updated documentation where required
